NOTIFICATION NO. 40/2008, DT. 17/09/2008

Amendments in Export Policy for Non Basmati Rice (seed quality) , Maize (corn) Seed quality & Durum Wheat (1006, 1005 & 1001)

S.O.(E) In exercise of the powers conferred by Section 5 read with Section 3(2) of the Foreign Trade (Development & Regulation) Act, 1992 (No.22 of 1992) and also read with Para 1.3 and Para 2.1 of the Foreign Trade Policy, 2004-2009, the Central Government hereby makes, with immediate effect, the following amendments to Notification No.32 (RE-2008)/2004-2009, dated 19th August, 2008 read with Notification No. 33 (RE-2007)/2004-2009, dated 8th October, 2007 as under:

2. (i) The entries relating to Tariff Item HS Code 10061010 against Sl. No. 45A in Notification No.93 (RE-2007)/2004-2009, dated 15.10.2007 would be substituted as under with immediate effect:

Export will be allowed subject to submission of following documents to Customs at the time of export: (i) A license to carry on the business of a dealer in seeds issued under Section 3 of the Seed Control Order (1983) from the State Government; and (ii) Declaration that the export consignment of seeds has been chemically treated and is not fit for human consumption; and 2. Export packets will be labeled that seeds are treated with chemical insecticides and cannot be used for food or feed purposes.

2 (ii). The entries relating to Tariff Item HS Code 10051000 against Sl. No. 46B in Notification No. 22 (RE-2008)/2004-2009, dated 3.7.2008 would be substituted as under, with immediate effect:

No. 46A of Chapter 10 under Schedule 2 of ITC (HS) Classifications of Export and Import items, inserted vide Notification No. 33 (RE-2007)/2004-2009, dated 8th October, 2007 would be substituted as under with immediate effect:
